Terms of Service

1. Eligibility and authority

You must be legally capable of entering into a binding agreement in your jurisdiction. If you use Snip Halo for a company, school, organization, or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.

You may not use the Service if applicable law prohibits you from receiving or using it.

2. The Snip Halo product

Snip Halo is downloadable screenshot software for macOS. Current functionality may include region and full-screen capture, local capture history, image annotation and styling, copying, saving, drag-and-drop export, optional Google Drive upload, license activation, keyboard shortcuts, and signed software updates.

Features may change over time. Product descriptions available at the time of purchase form part of the information on which you may rely, subject to applicable consumer law.

Snip Halo currently requires macOS 14 or later. Future versions may require a newer macOS version when reasonably necessary for security, platform compatibility, or development.

3. License grant

Subject to payment, valid activation, and compliance with these Terms, Megacubos grants you a limited, non-exclusive, non-sublicensable, non-transferable except as expressly permitted below, revocable license to install and use the purchased Snip Halo application for your own personal or internal business purposes.

The standard lifetime license may be activated on no more than two Macs at the same time. The checkout or license description controls if a different activation limit is expressly stated for a particular purchase.

You may deactivate one Mac and activate another, subject to reasonable technical and anti-fraud controls. If you permanently lose access to a Mac and cannot deactivate it, contact support with sufficient purchase information. We may reset an activation after reasonable verification.

This software license does not transfer ownership of Snip Halo, its trademarks, designs, proprietary source code, documentation, signing keys, or other intellectual property.

4. Meaning of “lifetime license”

A “lifetime license” means that the purchased license does not have a scheduled expiration date and may continue to activate and use Snip Halo subject to these Terms, license limits, technical compatibility, and the continued lawful operation of the product and required third-party platforms.

Updates released for the same Snip Halo product are made available to lifetime license holders without an additional license fee. However, a lifetime license is not a promise that:

• new updates or features will be developed indefinitely;
• every future macOS version or hardware platform will remain compatible;
• every third-party integration will remain available;
• support will be provided forever or within a guaranteed response time;
• internet hosting or third-party providers will operate without interruption; or
• a distinct successor product will be included unless we expressly say so.

Nothing in this section limits non-waivable rights under applicable consumer law.

5. Community, promotional, and complimentary licenses

A license provided without charge, through a 100% promotional code, community benefit, giveaway, educational promotion, or direct grant remains subject to these Terms and its stated activation limit. Unless expressly stated otherwise in writing, complimentary licenses provide the same application-use rights as paid lifetime licenses but have no cash value and may not be sold as standalone license keys.

An independently distributed educational source-code package is separate from the commercial Snip Halo application. Source code is governed only by the license included with that package. Support, updates, signing credentials, production OAuth credentials, Snip Halo branding rights, and commercial Snip Halo license keys are not included merely because a person has access to an educational source package.

6. License keys and account security

You are responsible for keeping your license key reasonably secure. You may use it for the activation limit associated with your purchase but may not publicly post, sell, rent, sublicense, mass-distribute, or use the key to operate more simultaneous installations than permitted.

License activation and periodic validation may require an internet connection. Snip Halo currently permits up to 60 days of offline use following a successful validation. An online validation may later be required to confirm that the license is active, belongs to the correct product, and remains within its activation limit.

We may disable or limit a license when reasonably necessary because of a refund, chargeback, fraud, public key distribution, material breach, unlawful use, sanctions requirements, or activation abuse. We will not intentionally disable a valid license merely because the application is temporarily offline within the supported offline period.

7. Purchases, taxes, and merchant of record

Purchases are processed by Lemon Squeezy or another checkout provider identified at purchase. Lemon Squeezy acts as merchant of record for transactions it processes and may handle payment collection, local taxes, receipts, fraud prevention, chargebacks, and customer billing information under its own terms.

Prices, currency, taxes, discounts, and the total amount are displayed at checkout. You authorize the checkout provider to charge the selected payment method for the displayed total.

Snip Halo does not require a recurring subscription when the checkout states that the product is a one-time purchase.

8. Refunds

Refund eligibility is governed by the policy presented at checkout, Lemon Squeezy's applicable procedures, mandatory consumer rights, and any written Snip Halo refund policy in effect when you purchase.

To request assistance, email support@megacubos.com with your order number and purchase email. Do not send complete payment-card information. Nothing in these Terms excludes refund, withdrawal, cancellation, or warranty rights that cannot lawfully be excluded.

Abuse of refunds, chargebacks, promotional codes, or payment disputes may result in license deactivation where permitted by law.

9. Installation and software updates

Snip Halo may be distributed as a signed and notarized DMG. You are responsible for downloading software from an official Snip Halo or authorized checkout link, moving the application to the Applications folder, maintaining a supported Mac, and installing applicable macOS security updates.

Snip Halo uses cryptographically signed updates. Depending on your settings, the application may check automatically or when you request a check. An update may download and replace the installed application after you approve it or according to update preferences made available by the software.

You may not bypass signature verification, distribute modified binaries as official Snip Halo releases, or present an unofficial update as originating from Megacubos, LLC.

10. Google Drive integration

Connecting Google Drive is optional. By choosing to connect, you authorize Snip Halo to use the permissions shown on Google's consent screen for the user-facing Drive functionality described in the application and Privacy Policy.

Drive uploads occur only when you initiate them. Uploaded files begin private. If you confirm the sharing warning, Snip Halo may create a permission that allows anyone with the link to view the file.

You are responsible for:

• selecting appropriate screenshots for upload;
• ensuring you have the legal right to upload and share the content;
• understanding that anyone with a public link may view or redistribute it;
• removing public permissions or deleting files when access should end;
• protecting your Google Account; and
• complying with Google's applicable terms.

Disconnecting Snip Halo does not automatically delete files already uploaded to Google Drive or revoke public links already created. Manage those files and permissions in Google Drive.

Google may change, suspend, or discontinue APIs or account access. We do not guarantee uninterrupted availability of a third-party integration.

11. Your content

As between you and Megacubos, you retain ownership of screenshots, annotations, text, and other content you create or process with Snip Halo (“Your Content”). These Terms do not grant Megacubos ownership of Your Content.

You grant third-party services only the permissions necessary for actions you choose, subject to their terms. For example, uploading a screenshot to Google Drive requires Google to store and deliver that file under your Google relationship.

You represent that Your Content and your use of it do not infringe intellectual property, privacy, confidentiality, publicity, contractual, or other rights and do not violate applicable law.

12. Acceptable use

You may not use Snip Halo to:

• violate applicable law or another person's rights;
• capture or disclose information when you are legally prohibited from doing so;
• harass, threaten, exploit, impersonate, defraud, or harm another person;
• create or distribute malware, phishing content, unlawful surveillance material, or credentials obtained without authorization;
• bypass access controls or security safeguards;
• interfere with the application, licensing service, update service, checkout, Google APIs, or related infrastructure;
• probe, scan, or test systems without authorization;
• automate abusive license activation or checkout activity;
• distribute maliciously modified versions as Snip Halo;
• remove proprietary notices from official distributions except where law expressly permits;
• use the Snip Halo name, logo, domain, or trade dress to mislead users about the source of another product; or
• enable others to do any of the above.

These restrictions do not prevent activities protected by applicable law, including lawful security research, interoperability, reverse engineering, or fair use to the extent such rights cannot be waived.

13. Intellectual property

Snip Halo, its official application, website, design, artwork, documentation, proprietary code, trademarks, and branding are owned by Megacubos, LLC or its licensors and are protected by applicable laws.

Third-party components included in the application remain subject to their respective licenses. Apple, macOS, Google, Google Drive, Lemon Squeezy, Cloudflare, and Sparkle are associated with their respective owners. Their names are used only to identify compatibility or third-party services.

No right to use Snip Halo branding, domains, signing certificates, OAuth credentials, update-signing keys, or production license infrastructure is granted unless Megacubos provides separate written permission.

14. Feedback

If you voluntarily provide suggestions or feedback, you grant Megacubos permission to use it without restriction or compensation, provided we do not publicly identify you without permission. This does not transfer ownership of Your Content or confidential business information clearly identified and accepted as confidential.

15. Beta, test, and preview features

Features identified as beta, test, preview, or experimental may be incomplete, change without notice, contain errors, or be discontinued. Do not rely on preview features for critical or regulated workflows. Test purchases and test license keys do not authorize production sales or guarantee that a store has been approved for live processing.

16. Third-party services

The Service may depend on third parties including Apple, Google, Lemon Squeezy, Cloudflare, and open-source software providers. Your use of third-party services may be governed by separate terms. Megacubos does not control their availability, policies, account decisions, or service changes.

We may replace a provider when reasonably necessary, provided we update relevant disclosures and preserve material product functionality where practical.

17. Suspension and termination

You may stop using Snip Halo at any time. You may deactivate a Mac through the application where available.

We may suspend access to licensing or services when reasonably necessary to investigate security incidents, prevent harm, comply with law, or address a material breach. We may terminate a license for material violation of these Terms after notice where appropriate, except when immediate action is reasonably necessary to prevent fraud, security harm, unlawful activity, or widespread license abuse.

Upon termination, the license grant ends. Provisions that by their nature should survive—including ownership, disclaimers, limitations, dispute provisions, and accrued payment obligations—will survive.

18. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNIP HALO IS PROVIDED “AS IS” AND “AS AVAILABLE.” MEGACUBOS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, CONTINUOUSLY AVAILABLE, COMPATIBLE WITH EVERY MAC OR THIRD-PARTY SERVICE, OR SUITABLE FOR MEDICAL, LEGAL, FINANCIAL, SAFETY-CRITICAL, EMERGENCY, OR REGULATED RECORDKEEPING.

YOU ARE RESPONSIBLE FOR REVIEWING CAPTURES BEFORE SHARING, MAINTAINING BACKUPS, PROTECTING PUBLIC LINKS, AND CONFIRMING THAT OUTPUT IS APPROPRIATE FOR YOUR PURPOSE.

Some jurisdictions do not allow certain warranty exclusions. Those exclusions apply only to the extent permitted, and your non-waivable statutory rights remain unaffected.

19. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEGACUBOS AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, CONTENT, OR USE, ARISING FROM OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO SNIP HALO WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE LICENSE GIVING RISE TO THE CLAIM OR (B) USD 25.

These limits do not apply where liability cannot lawfully be limited, including liability that applicable law makes non-excludable. Some jurisdictions may provide additional consumer remedies.

20. Indemnification

To the extent permitted by law, if you use Snip Halo on behalf of a business or organization, that entity will defend and indemnify Megacubos against third-party claims, damages, and reasonable costs arising from unlawful use, Your Content, violation of another person's rights, or material breach of these Terms. This section does not apply to individual consumers where prohibited by applicable law.

21. Governing law and venue

These Terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law principles. Subject to mandatory consumer-law rights, disputes that cannot be resolved informally will be brought in the state or federal courts with jurisdiction in New Castle County, Delaware, and the parties consent to those courts.

If you are a consumer in a jurisdiction that grants mandatory rights to bring claims in your home courts or under local law, this section does not remove those rights.

22. Export controls and sanctions

You may not use, export, re-export, transfer, or make Snip Halo available in violation of United States export controls, sanctions, or other applicable trade laws. You represent that you are not prohibited from receiving the software under applicable law.

23. Changes to the Service or Terms

We may update the Service and these Terms for new features, provider changes, security, legal requirements, or business operations. We will update the “Last updated” date and provide additional notice when required.

Changes will apply prospectively. If a material change requires consent under applicable law, we will request it. Continued use after an effective update constitutes acceptance where permitted by law.

24. General provisions

These Terms and documents expressly incorporated by reference form the agreement concerning the Service. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue.

Our failure to enforce a provision is not a waiver. You may not assign these Terms or a license except as expressly permitted. Megacubos may assign them in connection with a merger, acquisition, reorganization, financing, or sale of relevant assets, subject to applicable law.

Headings are for convenience only. “Including” means “including without limitation.” Electronic communications and records may satisfy writing requirements where permitted by law.
